PART E. GENERAL PROVISIONS FOR THE SALE OF BIKES TO END CUSTOMERS (CONSUMERS)


1 Applicability

These General Terms and Conditions of Sale apply to the sale of bikes by LikedBikes to end customers (consumers).

2 Conclusion of Contract – Online Store Order (www.likedbikes.com)

The end customer (consumer) selects the desired bikes via the online store and places a binding order. By submitting the order, a binding purchase contract is concluded. The end customer (consumer) receives the order confirmation immediately after payment.

3 Invoicing

The agreed purchase price is due prior to delivery. Delivery of the contracted items will only take place after receipt of payment. LikedBikes sends the download link for the invoice to the email address provided by the customer.

4 Shipping and Delivery

After a successful order, the goods are prepared and picked (ready for shipment within 1–4 business days). Once shipping preparations are complete, the end customer (consumer) receives an email from LikedBikes with the shipping information. The ordered bikes are shipped to the delivery address provided by the customer.

Delivery time from shipment depends on the selected shipping method:

- Standard shipping within Germany: 2 to 5 business days

- Standard shipping to other EU countries: 3 to 10 business days

- Express shipping within Germany: 1 to 2 business days

- Express shipping to other countries: 2 to 4 business days

The end customer (consumer) is responsible for mounting the pedals, adjusting the handlebars and brake levers, and, depending on the model, mounting the display on the handlebars after receiving the bikes.

5 In-Store Pickup

After a successful order, the goods are prepared and picked (ready for pickup within 1–4 business days). Once preparation for pickup is complete, the end customer (consumer) will receive an email from LikedBikes with the pickup information. The end customer (consumer) must pick up the ordered bikes at the selected store location (Service Center: Gewerkenstraße 19, 83435 Bad Reichenhall, Germany) at the agreed-upon time at their own expense. The final pickup date is coordinated between LikedBikes and the customer. 

6 Condition of “Refurbished” Bikes

The bikes are in technically perfect condition and are fully serviced prior to delivery:

Defective or worn parts are replaced according to the following criteria:

- Brake pads: Replaced when the manufacturer’s defined wear limit is reached

- Brake rotor: Replaced when the manufacturer’s defined wear limit is reached

- Tires: Replaced if there is visible wear or damage

- Chain: Replaced if elongation exceeds the tolerance limit (depending on the drivetrain type)

- Chainring/sprocket: Replacement upon deformation or damage

- Grips: Replacement upon visible wear or damage

- Pedals: Replacement upon visible wear or damage

- Battery/motor/display/control unit: Replacement upon damage or malfunction

- Other parts not listed: Replacement in case of visible wear, manufacturer-defined wear limit, or damage

The bikes may show slight signs of wear from use (visual condition as per shop specifications or images).

The scope of delivery for a refurbished e-bike (pedelec) includes the following parts:

• At least 1 battery key

• Battery

• Display or control unit

• Charger

7 Takeover following a rental agreement

If a bike is taken over by an end customer (consumer) from a previous contractual relationship between movelo and a customer, no service (as per Section 6) will be provided prior to takeover by LikedBikes / movelo. The condition of the bike is known to the end customer (consumer), and the refurbishment is the responsibility of the end customer (consumer).

8 Right of Withdrawal

The right of withdrawal for the end customer (consumer) is governed by statutory provisions.

8.1 Notice of Right of Withdrawal

The end customer (consumer) has the right to withdraw from this contract within fourteen days without giving any reason.

movelo reserves the right to refuse the withdrawal due to excessive use (mileage of the bike at the time of withdrawal > mileage of the bike at the time of pickup + 50 km).

The withdrawal period is fourteen days from the day on which the end customer (consumer) or a third party designated by them, who is not the carrier, took possession of the last item. To exercise the right of withdrawal, the end customer (consumer) must inform LikedBikes of their decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email to info@likedbikes.com). The end customer (consumer) must use the model withdrawal form for this purpose.

 

To meet the withdrawal deadline, it is sufficient for the notification regarding the exercise of the right of withdrawal to be sent before the withdrawal period expires.

8.2 Consequences of Withdrawal

If the end customer (consumer) withdraws from this contract, LikedBikes must refund to the end customer (consumer) all payments that LikedBikes has received from the end customer (consumer) without delay and no later than fourteen days from the day on which LikedBikes received notification of the withdrawal from this contract. For this refund, the same payment method used in the original transaction will be used, unless expressly agreed otherwise. Under no circumstances will fees be charged for this refund. LikedBikes may withhold the refund until LikedBikes has received the contractual items back in full (original scope of delivery). The deadline is met if the items covered by the contract are shipped before the fourteen-day period expires.

LikedBikes will arrange for the return shipment of the ordered bikes after the end customer (consumer) has notified LikedBikes of the cancellation of this contract.

The end customer (consumer) must immediately pack the bikes, including the original scope of delivery, and hand them over to the designated carrier on the agreed date. The end customer (consumer) bears the costs of returning the contractual items in the amount of EUR 79 gross. The end customer (consumer) is only liable for any loss in value of the contractual items if such loss in value is attributable to handling by the end customer (consumer) that is not necessary for inspecting the nature, characteristics, and functionality of the contractual items, or if the return is not sent back properly in the original packaging.

8.3 Model Withdrawal Form

The model withdrawal form is available to the end customer (consumer) for free download (www.likedbikes.com/pages/revocation).

9 Warranty

The statutory rights regarding liability for defects apply to the contractual items. The warranty period for used bikes (refurbished condition) is 12 months for the end customer (consumer); for new bikes, the period is 24 months. If the delivered bikes are defective, the end customer (consumer) must report this via email to info@likedbikes.com. The end customer (consumer) may initially demand that the defect be remedied or that defect-free contractual items be delivered. LikedBikes may refuse the type of subsequent performance chosen by the end customer (consumer) if this is only possible at disproportionate cost. To remedy the defect, LikedBikes will arrange for a partner dealer in consultation with the end customer (consumer). If the defect cannot be remedied by a partner dealer, LikedBikes will arrange for the bike to be transported from the end customer (consumer) to LikedBikes.

Should it turn out that this is not a warranty claim, LikedBikes will invoice the end customer (consumer) for the actual transportation costs incurred.

10 Duty to Inform: Dispute Resolution

LikedBikes is neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.



PART F. GENERAL PROVISIONS FOR THE SALE OF BIKES TO BUSINESS CUSTOMERS


1 Applicability

These General Terms and Conditions of Sale apply to the sale of bikes by LikedBikes to business customers.

2 Conclusion of Contract – Order via Online Store (www.likedbikes.com/pages/b2b-portal)

The business customer selects the desired products via the online store and places a binding order. A binding purchase contract is concluded upon submission of the order. After submitting the order, the customer receives an order confirmation.

3 Invoicing

Unless otherwise agreed, the agreed purchase price is due prior to delivery. Delivery of the contracted goods will only take place after receipt of payment.

LikedBikes sends the download link for the invoice to the email address provided by the customer.

In the event of non-payment, LikedBikes reserves the right to cancel the contract for a reasonable administrative fee (10% of the order value).

4 Retention of Title

If LikedBikes makes an advance payment, LikedBikes retains title to the delivered contractual items until the purchase price owed has been paid in full.

5 Shipping and Delivery

Unless otherwise agreed in accordance with Section 3, the preparation and picking of goods takes place within 1–4 business days after receipt of payment.

Once shipping preparations are complete, the business customer will receive an email from LikedBikes containing the shipping information. The ordered bikes will be shipped to the delivery address provided by the customer.

The delivery time from shipment depends on the selected shipping method:

- Standard shipping within Germany: 2 to 5 business days

- Standard shipping to other EU countries: 3 to 10 business days

- Express shipping within Germany: 1 to 2 business days

- Express shipping to other countries: 2 to 4 business days

movelo reserves the right to determine the delivery time (including order fulfillment time) separately between LikedBikes and the business customer for large orders (order quantity ≥ 50 bikes).

The business customer is responsible for mounting the pedals, adjusting the handlebars and brake levers, and, depending on the model, mounting the display on the handlebars after receiving the bikes.

6 Self-Pickup

Unless otherwise agreed upon in accordance with Section 3, order preparation and fulfillment will take place within 1–4 business days after receipt of payment. Once preparation for pickup is complete, the business customer will receive an email from LikedBikes containing the pickup information. The business customer must pick up the ordered bikes at the selected store location (Service Center: Gewerkenstraße 19, 83435 Bad Reichenhall, Germany) at the agreed-upon time and at their own expense. The final pickup date will be coordinated between LikedBikes and the customer.

movelo reserves the right to stipulate that, for large orders (order quantity ≥ 50 bikes), the delivery time (including the order fulfillment period) will be determined separately between LikedBikes and the business customer.

7 Condition of “Unrefurbished” Bikes

Unrefurbished bikes are delivered directly from the lessee to the business customer upon expiration of the lease agreement.

The condition of the bike corresponds to its condition at the end of the lease agreement. LikedBikes has no influence on the condition of the bike.

The refurbishment of the bike is the responsibility of the business customer.

Upon receipt of the goods, the business customer has the right to withdraw from the purchase agreement if the refurbishment of the bike is economically disproportionate. The business customer’s complaint must be submitted in accordance with Section 9.

If the business customer exercises their right of withdrawal, they bear all logistics costs (delivery & return shipping). LikedBikes organizes the return shipping. The purchase price refund will be issued only after receipt and inspection of the bike.

The scope of delivery for an unrefurbished e-bike (pedelec) includes the following parts:

• At least 1 battery key (net price EUR 20)

• Battery (net price EUR 200)

• Display or control unit (net price EUR 50)

• Charger (net price EUR 50)

For missing parts, the business customer may request a price reduction based on the prices listed above.

LikedBikes is entitled to withdraw from the purchase agreement if the costs for missing parts are disproportionate. In this case, LikedBikes will bear the costs of return shipping.

8 Condition of “Refurbished” Bikes

The bikes are generally (i.e., unless LikedBikes and the business customer expressly agree otherwise) in technically sound condition and are fully serviced prior to delivery:

Defective or worn parts are replaced according to the following criteria:

- Brake pads: Replacement upon reaching the wear limit defined by the manufacturer

- Brake disc: Replaced when the manufacturer’s defined wear limit is reached

- Tires: Replaced if there is visible wear or damage

- Chain: Replaced if elongation exceeds the tolerance limit (depending on the drivetrain type)

- Chainring/sprocket: Replaced if deformed or damaged

- Grips: Replacement when visible wear or damage is present

- Pedals: Replacement when visible wear or damage is present

- Battery/motor/display/control unit: Replacement in case of damage or malfunction

- Other parts not listed: Replacement when visible wear, the manufacturer’s defined wear limit, or damage is present

The scope of delivery for a refurbished e-bike (pedelec) includes the following parts:

9 Acceptance of the Contractual Items

The business customer is obligated to accept the contractual items. If the contractual items are complete and in the condition specified in the contract in accordance with Section 7 or Section 8, the business customer confirms acceptance by signing the delivery note.

 

If the contractual items are not in the condition specified in the contract, this must be noted on the delivery note and reported to LikedBikes via email to info@likedbikes.com, including photographic evidence if possible, within 5 business days of acceptance of the contractual items. LikedBikes will review and address the complaint.

10 Transfer of Risk

From the time the business customer confirms acceptance of the contractual items, the business customer bears the risk of damage to or loss of the contractual items. The occurrence of a loss event does not release the business customer from their obligations under the contract.

11 Warranty for Business Customers

The statutory rights regarding liability for defects apply to the contractual items, unless otherwise agreed below. LikedBikes has the choice of the type of subsequent performance vis-à-vis the business customer. The statute of limitations for defects in new Contract Items is one year from the date of acceptance of the Contract Items. The statute of limitations does not restart if a replacement delivery is made under the warranty for defects. For used Contract Items (unrefurbished & refurbished condition), claims for defects against the Business Customer are excluded. The Contract Items are purchased “as is.”

PART G. GENERAL PROVISIONS FOR THE SALE OF BIKES AND PARK & CHARGE TO BUSINESS CUSTOMERS UPON THE EXPIRATION OF A RENTAL AGREEMENT


1 Applicability

These General Terms and Conditions of Sale apply to the sale of bikes and Park & Charge by LikedBikes to business customers. A prerequisite is an existing (rental) contractual relationship between movelo and a business customer.

2 Conclusion of Contract

LikedBikes sends the business customer an order summary including an invoice. After LikedBikes has sent the order summary and invoice, the binding contract with the business customer is concluded upon receipt of full payment. After payment has been made, the customer receives an order confirmation.

3 Retention of Title

The agreed-upon products remain the property of movelo / LikedBikes until the purchase price owed has been paid in full.

4 Condition of Bikes and Park & Charge

The business customer is aware of the condition of the bikes and/or Park & Charge, and preparation is the responsibility of the business customer. No refurbishment is performed by movelo / LikedBikes.

5 Warranty for Business Customers

The items covered by the contract are purchased “as is.” Claims for defects are excluded.
